I am most certainly NOT a lawyer. I may not even know what I am taling about. However, here are my thoughts.

I have not seen the other web page, but if it is as blatant as you claim, then they must KNOW that they will be caught, and they must also KNOW that they will certainly loose in court.

Knowing that the point above is true, they must have planned their strategy out well in advance. Is it possible that their strategy is to sell as much and make as much money as possible in a short time? Then, the money can be passed to relatives and friends as "salary". Finally, when you win in court, the defendants simply declare bankruptcy. You get no money, and their friends and relatives have a lot more money, which can be returned later.

In short, is it possible that they knew all along that they will loose, and have found a way to keep the money anyways?

I could be way off base here. It just seems to me that to be able to publish and distribute a magazine and set up a web store, you cannot be stupid.
