Effective April 15, 2014, the Department of Health and Human Services (HHS) will require “any digital media site, including, but not limited to, bulletin boards, websites, social media pages, or discussion groups with a forum or comments section with more than 50 Regular Posters" to have "all Regular Posters provide proof the Regular Poster has a health insurance policy compliant with the Affordable Care Act (ACA), or paid a ‘Poster Non-Compliance Contribution' (PNCC), or has received an exemption rom HHS, before they are allowed to post content on the site.”

According to the ACA, this rule was supposed to take effect on October 31, 2012, but has been repeatedly pushed back by HHS. Today they announced they will start enforcing the rule across the whole Internet in two weeks.

HHS and the IRS define a “Regular Poster” as “any person who spends more than 2.9 hours a week, on average, linked to the site in question.”

As E.T.S. has far more than 50 Regular Posters, all our Regular Posters must comply with this ACA rule or have their accounts frozen and all previous posts deleted. Regular Posters can enroll their compliance information, and complete the required compliance affidavit, by going to www.healthcare.gov/ets. If you choose to pay the 1-Percent of income PNCC instead, that can be sent directly to Doug.

While we regret having to take this action, Doug and the moderators could be fined $250,000 and go to jail for up to 20 years - for each infraction.
