I'm not so sure anyone should be charged. In situations like this where a young person is dead...that alone on the conscience of the people is enough punishment. Maybe that's too soft. I don't know.
That's what grand and trial juries are for. Personally, I consider the fact that those involved feel really bad about what happened is, at best, a mitigating factor in sentencing, not a defense as to their culpable negligence, if any.
